1401.02(c)    International Alphabetical List

In addition to the General Remarks, list of international classes, and explanatory notes (see TMEP §1401.02(a)), the Nice Classification includes the Alphabetical List of goods and services. The Alphabetical List provides guidance concerning classification of particular goods and services. The Alphabetical List is published by the World Intellectual Property Organization and is available online at A French version of the Alphabetical List is also available online. Note: The paper publication of the Nice Classification was discontinued in 2011 with the publication of the 10th edition.

As the Alphabetical List was developed to classify goods and services and not to identify specific goods and services, most entries in the Alphabetical List will not be sufficiently definite to use in an identification of goods and/or services.  If such entries are provided as identifications, the USPTO exercises its discretion to require greater particularity. See In re Omega SA, 494 F.3d 1362, 83 USPQ2d 1541 (Fed. Cir. 2007).

The USPTO’s Acceptable Identification of Goods and Services Manual ("ID Manual") provides general guidance on whether an identification is sufficiently definite. See TMEP §1402.04.
